MM21/03      Environmental Planning and Assessment Amendment (infrastructure Contributions) Bill 2021

Recommendation:

That Council:

1.       Calls on the NSW Government to withdraw the Environmental Planning and Assessment Amendment (Infrastructure Contributions) Bill 2021 (the Bill) from the NSW Parliament.

2.       Calls on the NSW Government to undertake further consultation with the local government sector on any proposed reforms to the infrastructure contributions system.

3.       Calls on the NSW Government to de-couple the Independent Pricing and Regulatory Tribunal led review of the rate peg to include population growth from the infrastructure contributions reforms.

4.       Writes to the local State Member Gurmesh Singh, the Premier the Hon Gladys Berejiklian MP, Treasurer the Hon Dominic Perrottet MP, Minister for Planning and Public Spaces the Hon Rob Stokes MP and Minister for Local Government the Hon Shelley Hancock MP seeking them to withdraw the Bill.

5.       Writes to the Shadow Treasurer the Hon Daniel Mookhey MLC, Shadow Minister for Planning and Public Spaces Mr Paul Scully MP, Shadow Minister for Local Government Mr Greg Warren MP, The Greens Mr David Shoebridge MLC, Shooters, Fishers and Farmers Party the Hon Robert Borsak MLC, Pauline Hanson’s One Nation the Hon Mark Latham MLC, Animal Justice Party the Hon Emma Hurst MLC, Christian Democratic Party (Fred Nile Group) the Hon Fred Nile MLC, Independent Mr Justin Field, Portfolio Committee Chair The Greens Ms Cate Faehmann, Portfolio Committee Deputy Chair Animal Justice Party the Hon Mark Pearson MLC and Committee members Liberal Party the Hon Catherine Cusack MLC and the Hon Shayne Mallard MLC, The Nationals the Hon Ben Franklin MLC and Australian Labor Party the Hon Rose Jackson MLC and the Hon Adam Searle MLC seeking their support in securing the withdrawal of the Bill from the NSW Parliament and outlining council’s concerns with the Bill.

6.       Alerts the local media to the threat of future ratepayer funds being expended rather than developer levies for new infrastructure brought about by increased development under the proposed legislation and shares and promotes these messages via its digital and social media channels and via its networks.

7.       Requests LGNSW continue advocating on Council’s behalf to protect local government from any amendments to infrastructure contributions which leaves councils and communities exposed to expending ratepayer funds on new infrastructure made necessary by new development, currently the responsibility of developers.

 

Background

I am calling on Councillors to support our local government sector’s campaign on infrastructure contributions reforms.

The NSW Government introduced the Environmental Planning and Assessment Amendment (Infrastructure Contributions) Bill 2021 into Parliament on 22 June.

The Bill was subsequently referred on 24 June 2021 to the Upper House Portfolio Committee No. 7 – Planning and Environment for inquiry and report on 10 August 2021.

Councils support efforts to reduce complexity, cut red tape and improve transparency and equity, however, implementation of the reforms will have far reaching financial implications for our council and community that are unknown at this stage and there is concern that we may be worse off under the reforms.

These reforms may force our council to delay or completely remove projects from our expenditure plan with a detrimental impact not only on community wellbeing and participation in civic life, but also crucially on job creation.

Councils need to be in a position to deliver quality infrastructure and open spaces if they are to attract homebuyers, housing and commercial development and business investment and these reforms put this at risk.

Councils also object to the Government’s decision to tie reform of the rate peg to cater for population growth to reductions in infrastructure contributions. Reform of the rate peg is required independent of changes to contributions. This presents a concerning cost shift from developers onto local government and ratepayers.

It is premature to push forward with this legislation while so much of the infrastructure reform agenda remains unknown.

Local Government NSW (LGNSW) has been advocating this position on our behalf and has met with the Minister for Planning and Public Spaces the Hon Rob Stokes MP on several occasions to stress that councils and their communities must not be worse off under any reforms.

LGNSW has made a submission to the parliamentary inquiry, opposing the passage of the Bill, and on Friday 16 July LGNSW President Linda Scott spoke at the inquiry hearing alongside other local government representatives to present a united front on this issue.

The Parliamentary Inquiry's report was released in early August 2021 with its one and only recommendation that:

the Environmental Planning and Assessment Amendment (Infrastructure Contributions) Bill 2021 not proceed, until the draft regulations have been released for consultation and the reviews into the rate pegging system, benchmarking and the essential works list have been published by IPART.

LGNSW will continue its advocacy efforts on our behalf and is asking councils in NSW to add their voice in calling on the NSW Government to withdraw the Bill from the NSW Parliament.

Executive Summary

The Deputy Mayor’s 12-month term ends in September 2021 and Council now is required to determine if it will again elect a Deputy Mayor.  If Council resolves to elect a deputy mayor, then Council will need to determine the election method, which must be open voting (show of hands) if any Councillor attends the meeting via audio-visual link.

 

This report seeks a decision and whether Council will elect a Deputy Mayor.  If so, the report also facilitates a decision on the election method, a call for nominees and the election.

 

 

Recommendation:

That Council:

1.       Resolve to elect a Deputy Mayor until either the Local Government Elections are held or for the following twelve (12) months (whichever is first),

and in the event that Council resolves recommendation 1 in the affirmative.

2.       Call for nominations for the position of Deputy Mayor and conduct the election by open voting (show of hands) due to the meeting being held via audio visual link.

 

Report

Description of Item:

Each September, Council elects a Deputy Mayor for 12-months to support the Mayor with performing ceremonial duties and exercise the Mayoral functions when the Mayor is absent.  As the Deputy Mayor’s term has ended, Council needs to decide whether it will again elect a Deputy Mayor.

 

In making this decision, Council needs to consider that as the Local Government Elections are now set for 4 December 2021, the Deputy Mayor’s term will cease on this date, unless the elections are further delayed.  If this were the case, then the elected Deputy Mayor would remain in the role until the date of the election, or September 2022.

 

Should Council resolve to elect a Deputy Mayor, the election method will need consideration. In previous years the deputy mayor elections have been conducted by ordinary (secret) ballot.  This method can only be used if all Councillors are present within the chamber.  If any Councillors attend the meeting via audio-visual link, the deputy mayor must be elected by open voting (show of hands) (see the OLG Circular in Attachment 1).

 

This report is seeking a decision on whether Council will elect a Deputy Mayor, and if so, seeks nominations and to conduct the election.

Issues:

It should be noted that as detailed in the attached Office of Local Government (OLG) Circular, councils are not required to elect a Deputy Mayor.

 

If Council wishes the conduct the election in person, the OLG Circular states that “In areas subject to stay at home restrictions under the Public Health Orders a person may leave their home for the purpose of undertaking any legal obligations and a person engaged in local government elections is an ‘authorised worker’ for the purpose of the Public Health Orders”.

Options:

Section 231 of the Local Government Act 1993 states that Council “may” elect a person from among their number to be the Deputy Mayor.  As a Deputy Mayor is not compulsory the options available to Council are:

 

1.    Council resolve not to have a Deputy Mayor.

2.    Council resolves to elect a Deputy Mayor for a term to be decided.  Should Council support this option, it will also need to resolve the method of voting based on whether and any Councillors are in attending via audio-visual link.

3.    All Councillors arrange to attend the meeting in-person, resolve to elect a Deputy Mayor and conduct the election by ordinary (secret) ballot.

Sustainability Assessment:

•     Environment

There are no environmental impacts as a result of this report.

•     Social

There are no social impacts as a result of this report.

•     Civic Leadership

Council’s election of a Deputy Mayor is consistent with the ‘My Coffs’ strategy, our leaders give us confidence in the future.

•     Economic – Broader Economic Implications

No additional fee applies to the position of Deputy Mayor.

 

There are no broad economic impacts associated with the implementation of the recommendation.

•     Economic - Delivery Program/Operational Plan Implications

There are no implications for the Delivery Program/Operational Plan.

Related Policy, Precedents and / or Statutory Requirements:

Section 231(2) of the Local Government Act 1993 states: ‘The person may be elected for the mayoral term or a shorter term’.  With the local government elections being postponed to December 2021, the Deputy Mayor elected with this resolution would hold the position up until that time.

 

Section 231 of the Local Government Act 1993 (Attachment 2) provides the power to elect a Deputy Mayor and clause 394 and schedule 7 of the Local Government (General) Regulations 2005 (Attachment 3) cover the procedures relating to the conduct of the election.

 

Attached to this report is a copy of these provisions and Council’s attention is drawn to the provisions relating to nominations and the methods of election.

 

Should there be more than one nomination for the position; Council is required, in accordance with clause 3 of schedule 7 (3) of the Local Government (General) Regulations 2005, to resolve whether the election is to proceed by preferential ballot, by ordinary ballot or by open voting.  Ballot has its normal meaning of secret ballot and open voting is a show of hands.

Implementation Date / Priority:

Implementation is immediate.

Conclusion:

Council is required to decide if it will elect a Deputy Mayor.  If so, Council will need to decide the term and election method based on whether and any Councillors are in attending via audio-visual link.

Executive Summary

The Cultural and Civic Space project always envisaged an official name for the building.

 

The Cultural and Civic Space (CCS) Project team in conjunction with local firm, saso creative, has undertaken a consultative process with the community which has culminated in a recommended name for the Cultural and Civic Space building.  The recommended name is Yarrila Place.  Yarrila is a Gumbaynggirr word that means “illuminate / brighten / light up / illustrate”.

 

A series of workshops in July 2021 with the general community and Gumbaynggirr clans generated a pool of potential names that has been filtered down to the recommended name.  This process is described in saso creative’s report which is Attachment 1.

 

Consultation demonstrated the community’s preference for a Gumbaynggirr name.  To quote from saso creative’s report (Attachment 1) “From all sources of data — across the workshops, the Have Your Say survey, the Ballot Boxes — and from listening to the buzz on the street in simply talking to people about a Name for the civic and cultural space building, the overwhelming message — really, quite startlingly overwhelming — was that the building’s Name should be of Gumbaynggirr origin.” “This was not in response to a specific leading question: it was entirely unprompted, unscripted, ad-lib and volunteered.”

 

Recommendation:

That Council adopt the name of Yarrila Place for the Cultural and Civic Space building.

 

Report

Description of Item:

This report provides an overview of the process undertaken to develop name options for the Cultural and Civic Space building.

Issues:

The Cultural and Civic Space project always envisaged an official name for the building.

 

The CCS Project, in conjunction with local firm, saso creative, has undertaken a consultative process with the community which has culminated in a recommended name for the Cultural and Civic Space building.  The recommended name is Yarrila Place.  Yarrila is a Gumbaynggirr word that means “illuminate / brighten / light up / illustrate”.

 

A series of workshops in July 2021 with the general community and Gumbaynggirr clans generated a pool of potential names that has been filtered down to the recommended name. Through the filtering process practicalities such as the following were considered:

 

·    Is it easy to say and spell (a particular obstacle for some Gumbaynggirr words)?

·    Is it distinctive and not used elsewhere?

·    Can it be shortened (as Aussies will) and what might it be shortened to?

·    Does it fit easily in signage and conversation?

·    Is it marketable and can it act as a marketing springboard to other institutions and activities?

·    Is it timeless or will it date before the paint is dry?

 

Use of a Gumbaynggirr word for “Place” was considered.  Saso creative sought input from Muurrbay Language and Culture Cooperative about this idea and the feedback indicated it wasn’t appropriate, doesn’t work in this sense, and that using ‘Place’ in English was a better approach.

 

This process is described in saso creative’s report which is Attachment 1, noting that the CCS Project considered input from all available sources, including saso creative’s process and Yandaarra Committee, and selected Yarrila Place as the recommended name from a shortlist of three names.

 

Consultation demonstrated the community’s preference for a Gumbaynggirr name.  To quote from saso creative’s report (Attachment 1) “From all sources of data — across the workshops, the Have Your Say survey, the Ballot Boxes — and from listening to the buzz on the street in simply talking to people about a Name for the civic and cultural space building, the overwhelming message — really, quite startlingly overwhelming — was that the building’s Name should be of Gumbaynggirr origin.”  “This was not in response to a specific leading question: it was entirely unprompted, unscripted, ad-lib and volunteered.”

 

The consultation process also considered the removal of the word “Place” from the various name options, noting that ultimately this is not recommended. As explained by saso creative “The new CCS building is a destination with a footprint and address. It ‘houses’ the institutions within. It’s playing a different role to the library, gallery, council etc. -- it’s a meta-structure as well as a destination in its own right. “Place” suggests a solidity, permanence and place (no pun intended) that “Yarrila” on its own doesn’t. It’s an anchor for the institutions within, as well as an anchor for the reactivated downtown; in this sense it draws on the synonymous ‘plaza’ (from which it’s derived) as a central space, a gathering or meeting place.”

 

Council’s Aboriginal Community Planner, has been involved in the process, particularly in the planning for and conduct of all indigenous community touch points, including the Yandaarra Committee.

 

Input from Council’s Communications Team has assisted in ensuring that the official building naming process is in alignment with current work being progressed on Council’s brand strategy evolution.

 

 

 

 

The building name sign is to be placed on the lower, brick part of the façade on Gordon Street. The CCS Project team anticipates a future report to propose a name for the combined gallery and museum in the CCS building.

Options:

The options are:

 

·    Accept the recommendation of Yarrila Place as the name for the CCS building noting that Yarrila is a Gumbaynggirr word that means “illuminate / brighten / light up / illustrate”.

 

·    Accept Miindalay Place as the name for the CCS building noting that Miindalay is a Gumbaynggirr word that means “becoming clever / learn”.

 

·    Accept Murrungba Place as the name for the CCS building, noting that Murrungba is a Gumbaynggirr word that means “make a circle”.

 

·    Reject all three shortlisted names and recommend an alternative methodology for the naming of the CCS building.

Sustainability Assessment:

•     Environment

It is not envisaged that there are any environmental impacts associated with Council considering the naming of the CCS building.

•     Social

Consultation demonstrated the community’s preference for a Gumbaynggirr name.  To quote from saso creative’s report (Attachment 1) “From all sources of data — across the workshops, the Have Your Say survey, the Ballot Boxes — and from listening to the buzz on the street in simply talking to people about a Name for the civic and cultural space building, the overwhelming message — really, quite startlingly overwhelming — was that the building’s Name should be of Gumbaynggirr origin.”

 

In conjunction with other CCS Project engagement with the Gumbaynggirr nation, in particular The Track and associated art work, this opportunity to adopt a Gumbaynggirr name for the CCS building has been warmly received and has the potential to positively influence the future of Council’s relationship with the local indigenous community.

•     Civic Leadership

Civic leadership is shown through the enactment of the community support for an indigenous name for the CCS building and is a strong manifestation of Council’s support for indigenous people and their culture.

•     Economic – Broader Economic Implications

Whilst difficult to quantify, there may be some positive broad economic outcomes arising from the naming of the CCS project. The creation of an identity from the naming of the CCS building may provide further assistance in creating awareness of the “place” and the facilities and opportunities within, thus generating broader interest and visitation.

•     Economic - Delivery Program/Operational Plan Implications

Naming of the CCS building is part of the scope of the CCS Project and is covered in the adopted budget for that project.

Risk Analysis:

The key risks considered are:

·     There is a risk that some Gumbaynggirr people may not agree with the chosen name.  This risk has been mitigated through the engagement of knowledge holders in each of the 6 Gumbaynggirr clan groups, Muurrbay and Yandaarra Committee in the naming process.

·     There is a risk that some members of the local community in the LGA may not agree with the name or with the selection of a Gumbaynggirr word for name, however it is unlikely that any name would receive unanimous support from the community.

Consultation:

A number of workshops were conducted: four workshops of 12 participants from the general population, and six workshops of 12 participants from the various indigenous clans of the Gumbaynggirr nation.

 

Muurrbay Language and Culture Cooperative was consulted to ensure the integrity, sensitivity and spelling of the proposed names.

 

Yandaarra Committee was consulted on the three shortlisted names for their advice and feedback. No issues were raised.

 

Internal consultation occurred within the organisation to ensure alignment with Council policies and strategies.

The naming and signage is to be completed as part of the CCS Project construction, due for completion October 2022.

Conclusion:

This report provides Council the opportunity to adopt an official name for the Cultural and Civic Space building.  Adoption of the name “Yarrila Place” is recommended.

Executive Summary

Local Government NSW (LGNSW) has advised Council that it is seeking voting delegates for the upcoming LGNSW Board elections and 2021 Annual Conference.  Due to the postponing of the Local Government Elections, the annual conference will only present the financial statements and the annual report, whilst motions will be tabled at a special conference in February 2022.  LGNSW is also seeking motions for the special conference as early as practicable.

 

This report seeks a resolution on the nominated authorised delegates to vote in the LGNSW board elections, the online 2021 LGNSW Annual Conference and call for motions for Council consideration to be tabled at the LGNSW Special Conference.

Report

Description of Item:

Local Government NSW (LGNSW) represents the interests of NSW general purpose councils, special purpose councils and the NSW Aboriginal Land Council.  LGNSW represents the views of councils by:

 

·     Advocating councils’ views to governments;

·     Promoting local government to the community; and

·     Providing specialist advice and services.

 

Local Government NSW has advised Council that the LGNSW Board elections are due and there has been changes to the LGNSW 2021 Annual Conference.  The recent postponing of the NSW local government elections to December 2021 has had a flow-on effect for the conference, which is now split into the following two components:

 

·     A one-hour Annual Conference to present the LGNSW annual report and financial reports, on Monday 29 November 2021; and

·     A Special Conference to debate and resolve motions to set the LGNSW advocacy agenda for 2022 from Monday 28 February to Wednesday 2 March 2022.

 

LGNSW is seeking the Council’s nominated voting delegates for the upcoming LGNSW Board Elections and the LGNSW Annual Conference, which are required by 5pm Tuesday 5 October 2021.  LGNSW is also requesting Council to consider submitting Conference Motions to be tabled at the LGNSW Special Conference as early as practicable.

 

This report is seeking a Council resolution to nominate voting delegates for the upcoming LGNSW Board Elections and the LGNSW Annual Conference and seeking motions for the LGNSW Special Conference.

Issues:

Annual Conference Registration

 

Registrations for the 2021 Annual Conference in November are open and Mayors, Councillors, General Managers and senior staff have been invited to register to attend (see the attached LGNSW invitation to the annual conference).  Councillor’s wishing to attend the conference are to contact the Mayor’s Assistant who will facilitate conference registration.

 

Registration as a Voting Delegate

 

Rule 23 of the LGNSW Rules provides the process for establishing the number of voting delegates that a member can have.  Coffs Harbour City Council will have four (4) voting delegates (see the attached LGNSW invitation to the annual conference).

 

It is understood that the same Councillors nominated to vote on motions at the conference can also be authorised to vote for the Association’s Office Bearers and Board.

 

The recommendation in this report therefore proposes that Council nominate the four (4) Councillors, one being the Mayor, proposed to have voting rights for the LGNSW Board Election and LGNSW 2021 Annual Conference.

 

LGNSW does not require the nominated voting delegates for the Special Conference until 5pm Thursday 17 February 2022.  A report will be presented to Council in early February to deal with this.

 

Submitting Motions to the Special Conference

 

LGNSW has advised that policy motions submitted by member councils are usually debated at each Annual Conference.  The unusual circumstances surrounding the 2021 Annual Conference means that on this occasion, motion debate will occur at the LGNSW Special Conference.  The deadline for inclusion of motions in the Business Paper is midnight on Sunday 30 January 2022.

 

The last ordinary meeting that motions can be presented to Council for consideration is scheduled for 25 November 2021. Councillors wishing to propose motions to be considered for the LGNSW Special Conference in February 2022 are to submit any such motions to the General Manager by close of business Wednesday 10 November 2021.

Options:

1.    Adopt the recommendations in this report and therefore resolve the authorised voting Delegates for the LGNSW board election and 2021 Annual Conference.

2.    Consider amending the recommendation with a view to establishing an alternate process for appointing voting Delegates to the Conference.

3.    Reject the recommendation and effectively not appoint voting Delegates to represent Council at the Conference.

There are no environmental impacts as a result of this report.

By attending the online LGNSW 2021 Annual Conference Coffs Harbour City Council, through its Delegates, will have the opportunity to represent the interests of the Coffs Harbour Community.  This is an appropriate civic leadership role for Council to play given its regional leadership role in NSW.

•     Economic – Broader Economic Implications

At this point in time, there does not appear to be any broader economic implications as a result of Council’s participation in the online LGNSW 2021 Annual Conference.

•     Economic - Delivery Program/Operational Plan Implications

It is normal practice to make provision for Councillors attendance at the annual conference of LGNSW and suitable provision is available in Council’s 2021/22 budget.

Risk Analysis:

It is not anticipated that there would be any real risks associated with Councillors attendance at the LGNSW 2021 annual Conference.

Consultation:

This report presents the first opportunity for consultation with Councillors in a formal sense to facilitate the necessary actions and outcomes associated with attendance at and voting on board elections at the LGNSW 2021 Annual Conference.

Related Policy, Precedents and / or Statutory Requirements:

Traditionally, Council has made attendance at the annual conference of NSW available to all sitting Councillors, whilst the appointment of authorised voting Delegates is restricted to those named by Resolution of Council.

Implementation Date / Priority:

Consideration of the recommendations in this report will enable Council to meet the timelines set out by LGNSW.

Conclusion:

It is appropriate that Council consider the authorised voting Delegates for the conference by way of resolving accordingly.  The recommendation in this report is therefore presented for Council’s consideration.

NOM21/20   Cultural and Civic Space Project Delegations

Motion:

Councillor Amos has given notice of his intention to move the following:

"That all contracts relating to the Cultural and Civic Space project in excess of $250,000 are to be determined by full council and not under delegated authority."

 

Rationale:

“This reverts the authority as to control of major variations on the Cultural and Civic Space project back to councillors, this more closely aligns care and responsibility for councillors to this project.”

Staff Comment:

At its meeting on 28 November 2019, Council resolved (Resolution No. 2019/209):

 

That all contracts including the Cultural & Civic Space proposed for Gordon Street Coffs Harbour in excess of the prescribed tender amount of $250K are to be determined by full Council and not under delegated authority.

 

From commentary shared post Council’s adoption of the above resolution, it is understood that some unintended consequences may have been captured by the resolution and subsequently it was suggested that the matter may be the subject of review at an appropriate time.  The term “That all contracts…” has the effect of capturing a broad range of matters, whether they be procurement or other matters.

 

Therefore, at its meeting on 12 March 2020, Council resolved (Resolution No. 2020/56):

 

That Council:

1.       Repeal Resolution 2019/209; and

2.       Resolve that where Council is proposing to procure goods and services where the value exceeds the prescribed tender threshold of $250,000, in respect of the Cultural and Civic Space Project, each resulting tender is to be determined by full Council.

 

This position provides Council with an increased level of approval beyond the delegations in the Tender Acceptance Policy adopted by Council.

 

The Cultural and Civic Space Project’s design and construction contract with Lipman Pty Ltd was approved by Council in February 2021, together with a total project end cost of $81.265M, which provided a level of contingency funding.  The contract, and project more generally, is required to be managed within this project end cost and any commitments or contract variations that exceed the project end cost of $81.265M currently require the approval of Council. With the awarding of the design and construction contract there is no expectation that further significant contracts will be required for the project.

 

If Council wishes to increase the governance arrangements for the approval of contract variations further, then the resolution will need to be specific in this regard, noting that this exceeds the approval arrangements for other Council contracts. However, Council also needs to be aware that the time requirements for approval of variations may cause delay in approval times, through the Council reporting process, and therefore lead to potential delay costs under the contract. The maximum delay penalty payable by Council to Lipman Pty Ltd under the design and construction contract is $19,674 excluding GST per day.

Executive Summary

This report presents the Monthly Financial Performance Report for the month ended 31 July 2021.  The report provides information on the actual to budget position at the financial statement level and capital expenditure reports for the current financial year.  As at 31 July 2021, the budget year to date surplus after capital revenue is $269,000 with the actual year to date surplus being $1.49 million.

 

The explanation of year to date variances is contained within the Income Statement commentary under Variance Comments for variances greater than 10%.  There are individual recurrent revenue sources with variances but overall recurrent revenue is on track, similarly for recurrent expenditure.

 

The capital expenditure target for the current financial year is $160.2 million with $5.5 million expended to the end of July 2021.

 

Recommendation:

That Council note the Monthly Financial Performance Report for 31 July 2021.

Description of Item:

The Monthly Financial Performance Report provides information on Council’s actual to budget performance.  The report provides accrual based information to Council on a monthly basis and designed to identify and explain any major variances between budgeted and actual results.  These figures are presented on an accrual basis except for rates, which from January 2021 are shown on a cash basis by the month.  This change in presentation more accurately reflects how the actual monthly and YTD operating result is tracking compared to budget.

 

The report includes:

 

Financial Management Summary

·     The net operating deficit, before capital revenue, of $1.05 million is $1.2 million better than the $2.25 million deficit expected.  The actual year to date surplus, after capital revenue, is $1.49 million against a budget of $269,000.  Operating expenditure to the end of July is $12.3 million against a budget of $13.3 million.

·     Capital expenses are on track with YTD budget expectations with total capital expenditure to the end of July of $5.5 million versus a YTD budget of $5.7 million.

 

Income Statement

·     This is a comprehensive income statement detailing the monthly performance for July 2021.  This statement compares actual to budget on a monthly and year to date basis at the financial statement level.  In terms of monthly percentages, although some percentages may be large in dollar terms, they have a minor impact on financial performance.  There are individual comments for any monthly and YTD variances greater than 10%.

 

Capital Expenditure Summary and Detailed

·     Capital expenditure by cost centre, and then at a more detailed level, is provided in the attachment.  There are some negative expenditures due to invoice accrual reversals from 2020-21.  Invoices are due to be received over the coming weeks.  Explanations have been provided for any variances greater than $200,000.

Executive Summary

This report summarises the unspent funds proposed to be revoted from the 2020/21 Operational Plan budgets into the 2021/22 Operational Plan budgets.  It is recommended that $2,416,361 of operational expenditure and $15,093,632 of capital expenditure be revoted.  It is also recommended that $588,060 of operational revenue and $2,253,524 of capital revenue be revoted.  The resulting impact on the 2021/22 budgeted Net Operating Result is a deterioration of $1.828M and therefore, the adopted 2021/22 budget deficit of $3.174M will be revised to a budget deficit of $5.002M.  The monthly and quarterly budget reviews will need to be monitored closely with a view to improving this result back to a balanced net operating position.

 

These revotes are necessary due to a variety of reasons including timing (project spans financial years), contractual obligations, commitments or monies held aside for specific purposes.  Council’s leadership teams have undergone a rigorous screening of all revotes to minimise their extent.  All revotes have been considered in line with Council’s Operational Plan and the Long Term Financial Plan.

 

A detailed summary of revotes by Directorate is provided in the body of the report along with the implications on the 2021/22 Operational Plan budgets by Fund.

Description of Item:

Although not a statutory requirement it is normal practice for Council’s to carry forward unspent money from one financial year to the next.  The majority of the revotes requested in this report are tied to grants and contributions from external bodies, developer contributions (Part 7:11 previously Section 94), reserve funds held for specific purposes and special rate variation funds as approved by IPART.

Issues:

All revotes have been considered in line with Council’s strategic plan and the Long Term Financial Plan.  Council has been vigilant in ensuring its commitments are met in a timely manner and has reduced its expenditure revotes from that which was approved in previous years.

The revoting of $15.1M in capital revotes will increase the total capital budget from $160.2M to $175.3M.  Council will prioritise the completion of grant funded projects in line with agreed milestones within the grant approval.  This may delay some capital works throughout the year with any impacts to be reflected as part of the Quarterly Budget Review process.

·    Jetty Memorial Theatre Operations $38,066 – project underway with Consultant appointed and strategic plan now returned from exhibition.  Adoption planned for September following business plan completion.  Project will be completed in full by December 2021.

·     Museum Collection Management $6,000 – fully grant funded, used for Preservation Needs assessment of museum collection.  Project completion due August 2021.

·     Museum Operating Grants $28,965 - grant funds from MGNSW. Project still in progress, to be completed in March 2022.

·     Cultural Strategic Plan & Performing Arts $192,622 – consultant contracted and project underway and progressing per milestones.  Completion timeframes dependent on future council decisions in 2021/22.

·     Indigenous Planning $11,958 - contracted Saltwater Freshwater event postponed due to COVID until 2021/22.

·     Regional State of the Environment (SOE) Reporting $38,231 – contributions received from other Councils to coordinate the development of the SOE report.  This is a legislative report moved to November per new election timeframe.

·     Integrated Transport Plan $15,063 - Transport Strategy not yet finalised but funding committed.

·     Rezoning Applications $143,629 – monies paid by applicants for rezoning planning proposals which are underway and subject to numerous reports to Council.  These contributions need to be held for use during the life of the rezoning process for each application, some of which can take several years to finalise.

·     Planning Studies $34,593 - numerous studies including North West Woolgoolga planning documents, Moonee Beach North new estate access, Woolgoolga and Jetty car parking studies funded via Part 7.11 funds within existing contributions plan.

·     Public Realm Strategy $90,114 - project spanning over multiple years and delayed due to Covid-19.  All remaining funds committed and to include community engagement also impacted by COVID.

·     Orara River Health and Rehabilitation Projects $166,993 – North Coast Local Land Services (NCLLS) 3-year contract, funded by a combination of Environmental Levy and grant.

·    Aboriginal Cultural Heritage Management Plan $36,903 – result of a Council resolution with funds required to remunerate consultants for project completion.

·    EL Orara River Rehabilitation Project $16,967 - weather has impacted ability to work on two large erosion sites.  In addition, Council is awaiting the outcome of two grant applications which will co-fund further works.

·     Coastal Hazard and Estuary Studies $107,863 – ongoing Coastal Management Plans and scoping studies, including Coffs Harbour Estuary Ecohealth, Boambee Newports Creek and Corindi Pine Clay Arrawarra part grant funded by Office of Environment and Heritage.

·     Campaigns Destination $38,950 – revenue collected from tourism businesses in June 2021 as a contribution for advertising in the new destination magazine.  The timing of the new publication required an up-front payment with the magazine print pending.

·     Business Events Support $117,460 - this funding has been raised through the business community with a commitment from Council that it would contribute to the attraction of major events.  Staging and support of events affected by COVID restrictions.

·     CCSLP Precinct Masterplan $25,802 - this project is currently under way and fully contracted, with a minor delay in invoicing.

·     Tennis Facility Strategic & Business Plan $23,933 - this project is currently under way and fully contracted.

·     Beach Storage Facilities $6,389 - Park Beach lifeguard facility improvements project nearing completion, with roof works to be completed December 2021.  Funded by adopted Developer Contributions Plan.

·     Shark Observation Program $2,540 – Department of Primary Industries grant funded drone project focusing on Park Beach area.  COVID delaying some equipment being sourced from overseas supplier, expecting completion by December 2021.

·     Flood Mitigation Works $64,224 – primarily Middle Creek flood study and management plan which is 2:1 grant funded.

·     Animal Impounding Facility Construction $204,919 - the tender process was undertaken in early 2021 and contractors have been engaged.  Construction is currently underway and the funds will be required to meet the tender costs agreed with the contractor.  It is envisaged the project will be complete by December 2021.

·     Solitary Island Coastal Walk Interpretive Sign $24,212 – partially grant funded, delayed due to COVID restrictions.  Expected to be completed by end of September.

·     Coffs Coast Regional Sports Hub $4,543,088 – this project is set for completion in December 2021, with remaining funds most likely spent by the third quarter of 2021/22.

·     Toormina Oval New Amenities $170,427 – project is almost 50% through construction.  On track and on budget, with completion expected late in this calendar year.

·     Stronger Country Communities Fund $683 – final costs for Sawtell BMX Club Track Upgrade.

·     Wiigulga Sports Complex ($461,665) – excess funds spent in 2020/21 to reduce 2021/22 allocations.  This project expected to be completed by the end of 2022.

·     Stormwater Planning Studies $468,903 – to progress flood catchment issues and stormwater management plans in Coffs Creek, Boambee Newports Creek and the Northern LGA flood study.

·     Better Waste and Recycling Fund Works $153,555 – remaining EPA operating grant funds for community education to reduce contamination, illegal dumping cameras, charity stores education, audit of kerbside bins and Lowanna Transfer Station improvements.

·     Gallows Beach Carpark Litter Reduction $1,739 – grant for ongoing works.

·     Speed Management Engineering $3,988 – fully RMS grant funded for relocation of signage and line marking.

·     Park Avenue Upgrade and Landscaping $180,000 - street furniture improvements along with reconfiguration of Moonee Street and Park Avenue.  The CBD capital works are funded by the special rate and majority of unspent funds have been returned to the CBD reserve.

·     Stage 5 Jetty Foreshores Carpark $541,382 – revote primarily funded by Community Facilities reserve.  Project completed in August with final invoices to be paid shortly thereafter.

·     Whale Tail Land Purchase $450,000 - grant funding from NSW Public Spaces Legacy Program, in negotiations with NSW government regarding purchase of land.

·     Community Development Grant $92,969 – grant funded works at Nana Glen Playground & Car Park. Project underway and to be delivered by December 21.

·     Stronger Country Communities Fund Open Spaces ($13,485) – Sandy Beach Active Youth Space.  Project in detailed design and to be delivered by September.

·     The following Open Space Works of $8,894 are primarily Developer Contributions funded (Part 7.11) and remain incomplete or yet to commence:

a)    Coffs Creek Estuary – project completed, awaiting final invoices under the contract.

Natural Disaster Resilience Grants.

$6m loan over 20 years of which repayments are funded from the stormwater levy.

A further $6m loan over 10 years per Council resolution 11 March 2010 of which repayments are funded by special rate variation.

The majority of these funds are currently held in reserve, however some allocations need to be revoted as they straddle two financial years, including Nardie Street stormwater pipe renewal and Hogbin Drive Culvert works.

·     Flood Mitigation Works Investigation and Design $195,538 – funded from above unspent loan funds along with approved grants.  At analysis stage for works at Boambee / Newports Creek. In process of awarding contract for Park Beach options investigation.

3.    Reject the recommendation provided to Council.  This would amend the Operational Plan budgets back to their original position prior to the recommendation being sought.

Sustainability Assessment:

•     Environment

Environmental impacts in relation to expenditure being revoted in this report would have been dealt with at the time the original funds were allocated.

•     Social

The provision of basic infrastructure and community services is an essential requirement of maintaining community wellbeing.

 

It is acknowledged that the ongoing COVID pandemic will impact the provision of services, events, operational activities and infrastructure construction.  The financial repercussions will continue to be monitored with relevant impacts reflected through the Quarterly Budget Review process.  Council remains committed to the delivery of services and projects within the constraints of the relevant government and health advice.

•     Civic Leadership

Council has provided sound civic leadership in striving to reduce the deficit budgeted in the 2021/22 Operational Plan.  It will continue to endeavour to maintain similar forecasts in future years in line with the My Coffs Community Strategic Plan.

•     Economic – Broader Economic Implications

When dealing with increased community demands Council has to focus on the balance of providing services with the limited funds available.  Council must also ensure that a healthy financial position is maintained to ensure ongoing viability of the organisation.

•     Economic - Delivery Program/Operational Plan Implications

This report provides Council with an overview of the outcomes unable to be achieved last financial year but will be met in the current financial year.  The impact on the Net Operating Result is a deterioration of $1.828M.  The adopted deficit of $3.174M will be impacted by this deterioration resulting in a revised budget deficit of $5.002M.  The monthly and quarterly budget reviews will need to be monitored closely with a view to improving this result back to a balanced net operating position.

Risk Analysis:

Should Council not approve the recommended revotes, it risks not being able to complete projects which have already commenced.  This non-completion of works presents financial and reputational risks for Council.

Consultation:

The leadership teams met to review the requests for revotes which were put forward by each operational area of the Council.

Related Policy, Precedents and / or Statutory Requirements:

The Executive Leadership Team has provided guidelines to staff regarding their responsibilities relating to effective and transparent budget review and assessment processes.  This framework provides guidance in achieving the objective of a year-end balanced budget in the General Fund.  Each request was assessed against the revote criteria as outlined in the Budget Preparation and Review Procedure, namely:

 

No revotes for operational funding will be considered unless the funds are under contract, an order has been raised or they are linked to sources of funding such as, grants, contributions, loans, etc. or other significant reasons such as event planning and implementing and funding for venue operations covering reporting periods.

 

Any Capital Revote must provide a justification and be assessed by the Executive and then by Council.  This justification must demonstrate that the capital funds are required for a project that extends over financial years, that there are orders raised, the project is under contract, the funds directly relate to the expenditure of Section 7.11 or grant funding, or other significant matters.

 

However, due to the current COVID-19 pandemic leadership have provided some flexibility in the application of the procedure to ensure funds are revoted which will assist in stimulus and recovery during 2021/22.

Implementation Date / Priority:

The leadership teams will continue to monitor the organisation’s performance with a view to maintaining, and in some cases improving, service delivery in line with Council’s Operational Plan.

Conclusion:

This report summarises the proposed unspent funds to be revoted from the 2020/21 Operational Plan budgets into the 2021/22 Operational Plan budgets.  These revotes are necessary due to a variety of reasons including timing (project spans financial years), contractual obligations, commitments or monies held aside for specific purposes.  It is recommended that Council adopt the revotes as detailed in this report.

Executive Summary

Since 2011, Council has been systematically updating its planning framework around coastal hazard management for the Coffs Harbour Local Government Area (LGA).

At its Ordinary Meeting of 9 May 2019, Council resolved to endorse an updated Coastal Zone Management Plan and updated Coastal Erosion Hazard Mapping, and to consider a further report in relation to inserting the updated mapping within State Environmental Planning Policy (Coastal Management) 2018 (‘Coastal Management SEPP’).

The purpose of this report is to respond to that resolution and to seek Council’s endorsement to initiate a planning process (via a planning proposal) to include ‘coastal vulnerability area’ mapping for the Coffs Harbour LGA within the Coastal Management SEPP and to publicly exhibit associated amendments to Council’s Local Environmental Plan (LEP) and Development Control Plan (DCP), in conjunction with a Coastal Vulnerability Area Policy.

 

Recommendation:

That Council:

1.       Endorse and forward a Planning Proposal (Attachment 1) to the NSW Department of Planning, Industry and Environment seeking a Gateway Determination to include Coastal Vulnerability Area mapping for the Coffs Harbour Local Government Area within State Environmental Planning Policy (Coastal Management) 2018 and to subsequently remove Clause 7.7 Limited Development on Foreshore Area from Coffs Harbour Local Environmental Plan 2013.

2.       Request that the Secretary of the NSW Department of Planning, Industry and Environment issue a written authorisation to Council to exercise delegation of the plan making functions under section 3.36(2) of the Environmental Planning and Assessment Act 1979 in respect of the Planning Proposal.

3.       Publicly exhibit the Planning Proposal and undertake government agency consultation subject to the terms of the Gateway Determination issued by the NSW Department of Planning, Industry and Environment.

4.       Publicly exhibit the draft Coffs Harbour Development Control Plan 2015 – Amendment No. 21 (Coastal Vulnerability Area) (Attachment 2) concurrently with the Planning Proposal.

5.       Publicly exhibit the draft Coastal Vulnerability Area Policy (Attachment 3) for a period of 28 days and provide public notice of its intention to adopt the policy in accordance with Section 160 (2) of the Local Government Act 1993.

6.       Consider a further report, outlining the outcomes of the public exhibition process of the Planning Proposal, draft Development Control Plan and draft Council Policy.

Description of Item:

Council commenced a planning process to manage coastal hazard within the Coffs Harbour LGA in 2011 with the adoption of a Coastal Processes and Hazards Definitions Study, closely followed by the adoption of a Coastal Zone Management Study in 2012 and a Coastal Zone Management Plan in 2013.

On 27 November 2014, Council resolved to exhibit a revised policy and updated local planning controls on coastal hazard management within the Coffs Harbour LGA. On 10 December 2015, Council resolved to defer the progression of the updated policy and planning controls, pending a report on the NSW coastal management reforms that were underway at that time. On 25 February 2016, Council resolved to lodge a submission to the reforms, in which it requested that the NSW Government include Council’s coastal erosion hazard mapping within a proposed State-wide policy for coastal management. On 8 December 2016, Council resolved to seek certification of the Coffs Harbour Coastal Zone Management Plan 2013 and a number of estuary specific coastal zone management plans for the LGA. The Coffs Harbour Coastal Zone Management Plan 2013 was certified and gazetted in 2018 by the NSW Government.

Following completion of the NSW coastal management reforms in 2018, a planning process for coastal management within the Coffs Harbour LGA was reported to Council at its Ordinary Meeting of 9 May 2019, along with an updated Coastal Zone Management Plan and updated Coastal Erosion Hazard Mapping (to refine mapping accuracy in Arrawarra, Woolgoolga, Sandy Beach and Emerald Beach). At that meeting, it was resolved:

That Council:

1.    Adopt the updated Coffs Harbour Coastal Zone Management Plan and Coastal Erosion Hazard Mapping (Attachment 1).

2.    Make the updated Coastal Erosion Hazard Mapping available on the Council’s external online mapping tool.

3.    Note a further report will be brought back to Council regarding amending the currently unmapped Coastal Vulnerability Area in the State Environmental Planning Policy Coastal Management 2018.

In accordance with Item 3 of that resolution, the purpose of this report is to seek Council’s endorsement to initiate a planning proposal (Attachment 1) to include ‘coastal vulnerability area’ mapping for the Coffs Harbour LGA within State Environmental Planning Policy (Coastal Management) 2018. The planning proposal also includes an amendment to Coffs Harbour LEP 2013 to remove Clause 7.7 Limited Development on Foreshore Area and the associated map, as it will no longer be required once the proposed LEP amendment is made.

 

This report also seeks Council’s endorsement to publicly exhibit draft Coffs Harbour DCP 2015 - Amendment No. 21 (Coastal Vulnerability Area) (Attachment 2) and draft Coastal Vulnerability Area Policy (Attachment 3). The DCP and Policy will assist Council and the community to interpret the coastal vulnerability area for the LGA.

Issues:

·   Previous Planning Approach

Council at its Ordinary Meeting of 27 November 2014 resolved to exhibit a revised policy and updated local planning controls on coastal hazard management within the Coffs Harbour LGA to accord with an action within the Coffs Harbour Coastal Zone Management Plan 2013. The approach at that time was to introduce a new coastal hazard clause and associated mapping into Coffs Harbour LEP 2013.

The draft planning controls were prescriptive in nature. Council received 111 submissions on the draft planning controls, in which a number of issues were raised, particularly in relation to the restrictive nature of the controls. In its consideration of the submissions, Council at its Ordinary Meeting of 10 December 2015, resolved to defer the progression of the new planning framework, pending a report on the NSW coastal management reforms that were underway at that time. Certification of the Coffs Harbour Coastal Zone Management Plan 2013 in 2018 was also seen as a key aspect to solidifying planning controls relating to coastal hazard management within the Coffs Harbour LGA.

The NSW coastal management reforms resulted in the introduction of the Coastal Management SEPP, which removed the need for a new clause to be included within Coffs Harbour LEP 2013. This report seeks Council’s endorsement to initiate a new planning proposal, draft DCP controls and a revised Council policy, which reflect the coastal management planning framework introduced by the NSW Government in 2018. This new draft planning framework is based on merit assessment, unlike the previous planning process exhibited by Council, and relies on the criteria in the Coastal Management SEPP relating to information required to support development proposals.

The Coastal Management SEPP contains provisions relating to a ‘coastal vulnerability area’ and provides the opportunity for Councils within NSW to include their own coastal hazard mapping to enact the clause. The coastal vulnerability area aims to manage risk to human life and public/private property that may be impacted by coastal hazard now and into the future. It is defined in the Coastal Management Act 2016 as land which is subject to coastal hazard, including (but not limited to) beach erosion and shoreline recession. Whilst development is permitted within the coastal vulnerability area under this policy, development proposals are required to satisfy criteria and are assessed on merit by the relevant consent authority (usually Council).

Council requested the NSW Government, in its submission to its draft policy, that its coastal erosion hazard mapping be included within the policy prior to it being made. The Coastal Management SEPP was however, made without the inclusion of any mapping for the State. Council has been advised by the NSW Department of Planning, Industry and Environment to undertake a planning proposal process to include its coastal erosion and hazard mapping within the state policy, which is the purpose of this report.

·   Coastal Vulnerability Area Mapping

The Coffs Harbour Coastal Zone Management Plan 2013 notes that planning decisions about residential development have a time frame of up to one hundred years and commercial and industrial development about fifty years, thus it is imperative that planning controls look beyond the immediate planning horizon and are based on a reasonable expectation that sea levels will rise over the long term. The ‘unlikely’ 2100 hazard line has been used to inform the coastal erosion hazard mapping that is to be identified as the ‘coastal vulnerability area’ within the Coastal Management SEPP. Coastal hazard within the Coffs Harbour LGA will be defined by probabilities in the Immediate, 2050 and 2100 year planning periods to enable Council to manage coastal hazard within a risk based framework, while also acknowledging a 0.4 m rise in sea level by 2050 and a 0.9 m sea level rise by 2100.

Options:

Council has a number of options available in relation to this matter. They include:

1.   Resolve to adopt the recommendations of this report.

2.   Resolve to undertake an alternative approach.

3.   Resolve not to adopt the recommendations of this report.

Option 1 is recommended as the suitable course of action.

Sustainability Assessment:

•     Environment

Environmental sustainability issues are addressed in the planning proposal (Attachment 1).

•     Social

Social sustainability issues are addressed in the planning proposal (Attachment 1).

•     Civic Leadership

The planning proposal accords with the following relevant objectives and associated strategies of the MyCoffs Community Strategic Plan by creating liveable neighbourhoods (C1.1) and undertaking sustainable development (C2.1).

•     Economic – Broader Economic Implications

Council will require an increased level of information for development within the coastal vulnerability area in relation to the development’s resilience in design, layout and function over the life of the development. While some of these factors may increase the overall cost of development, such costs reflect the nature of the hazard and are based on sustainable land use decision making.

•     Economic - Delivery Program/Operational Plan Implications

Council is the lead agency for the majority of the actions contained within the Coffs Harbour Coastal Zone Management Plan 2013, including the development of a new planning framework for the management of coastal hazard within the Coffs Harbour LGA. The new planning framework is unlikely to impact on Council’s Delivery Program or Operational Plan; as adequate resources are available within the organisation for the assessment of development applications relating to coastal hazard risk.

Risk Analysis:

Ensuring that new development is more resilient to coastal processes will reduce the risk and burden to future generations of inappropriate development that may generate an expectation for major public expenditure for land affected by coastal hazard. Resilient development that is responsive to known and predicted risk provides a better outcome for landowners in terms of risk to life and property.

Extensive community engagement was undertaken in the development of Council’s Coastal Zone Management Plan and Coastal Processes and Hazards Definition Study. The new planning framework will also be placed on public exhibition, thus minimising further risk to Council.

Consultation:

Should Council resolve to initiate the planning proposal and a gateway determination is issued by the NSW Department of Planning, Industry and Environment, the planning proposal is required to be exhibited in accordance with the gateway determination and the relevant provisions of the Environmental Planning and Assessment Act 1979. Consultation with government agencies and other stakeholders may also be required if specified within the gateway determination. Consultation will be undertaken in accordance with Council’s Community Participation and Engagement Plan, as follows:

Place Score:

In early 2019, Council undertook extensive community consultation using the Place Score place-making tool to understand community priorities and values. The Coffs Harbour LGA received a Place Score of 65, which is below the NSW average of 72. The top most ranked strength for the Coffs Harbour LGA in this study is “Elements of the Natural Environment”. Despite this strength, the community identified “Protection of the Natural Environment” in its top five priorities for improvement.

As part of the consultation process, the community also provided ideas for change, including “Celebrate and/or protect the topography and landscape” and “More and/or better sustainable actions and behaviours”. The new planning framework for the management of coastal hazard within the Coffs Harbour LGA will contribute to protecting elements of the natural environment.

Related Policy, Precedents and / or Statutory Requirements:

This planning proposal has been prepared in accordance with the Environmental Planning and Assessment Act 1979 and Regulation 2000. A number of other relevant policies and statutory documents have been considered in the preparation of the planning proposal.

Implementation Date / Priority:

Should Council resolve to initiate the planning proposal, it will be forwarded to the NSW Department of Planning, Industry and Environment, requesting gateway determination. The timeframe for the completion of the planning proposal is governed by the Environmental Planning and Assessment Act 1979 and thus is determined by the NSW Department of Planning, Industry and Environment. The DCP amendment and Council Policy will not take effect until the SEPP and LEP amendment process is finalised.

Conclusion:

The purpose of this report is to seek Council’s endorsement to initiate a planning proposal to include ‘coastal vulnerability area’ mapping for the Coffs Harbour LGA within the Coastal Management SEPP and to publicly exhibit associated amendments to Council’s LEP and DCP, in conjunction with a Coastal Vulnerability Area Policy.The new planning framework for the management of coastal hazard within the Coffs Harbour LGA is supported by sufficient evidence and will provide a simplified and fair merits based assessment of development on land impacted by coastal hazard.

Executive Summary

This report provides an assessment of Development Application No. 0028/21 for a dual occupancy (detached) involving the construction of one dwelling at Lot 256 DP 752853, 119 Condons Road, Sandy Beach.

At its meeting of 12 October 2017, Council adopted the ‘Development Applications - Consideration by Council Policy’, which outlined:

That development applications for approval involving substantial aspects of the following elements be referred to Council for determination:

-     Significant public interest and community input;

-     A proposed variation to the Local Environmental Plan that varies from the development standard by more than 10%;

-     Significant land use; and

-     Major environmental issues.

The development application is reported to Council for determination because it proposes to vary development standards in the Local Environmental Plan by more than 10%.

 

Recommendation:

That Council:

1.       Support the request to vary a development standard made pursuant to Clause 4.6 of Coffs Harbour Local Environmental Plan 2013 for the variation to the following development standards of the Coffs Harbour Local Environmental Plan 2013:

1.1.    Vehicular access under Clause 4.2E(2)(b);

1.2.    Minimum separation distance between dwellings under Clause 4.2E(2)(c); and

1.3.    Height of buildings under Clause 4.3.

2.       Approve Development Application No. 0028/21 for a dual occupancy (detached) at Lot 256 DP 752853, 119 Condons Road, Sandy Beach, subject to the conditions provided in Attachment 3.

3.       Advise persons who made a submission on Development Application No. 0028/21 of Council’s decision.

Description of Item:

•     The Site

The site is 119 Condons Road (Lot 256 DP 752853), Sandy Beach. The site comprises an area of 3.5 hectares. The surrounding properties are zoned RU2 Rural Landscape. An existing single storey dwelling and outbuildings (sheds) are located towards the northeast corner of the site towards Condons Road.

The land is an irregular shaped allotment. The site is bound to the west by the Wedding Bells State Forest, the northern boundary defined by Condons Road and to the north, south and east of the subject site are several rural properties with dwellings.

The land falls eastwards from the western boundary at approximately 197 metres Australian Height Datum (AHD) to the eastern boundary at 80 metres AHD.

Existing vehicular access is available to the site off Condons Road servicing an existing dwelling towards the north eastern boundary.

The land is mainly cleared.  A very small part of the site (adjoining the western boundary) is mapped as secondary koala habitat.

•     The Development

The proposal is for a dual occupancy (detached).

Specifically, the proposal is for the construction of a two storey dwelling house on the upper slope of the land; the proposed dwelling will be the second dwelling on the land and, as such, constitutes a detached dual occupancy development.

Issues:

The main assessment issues for the proposed development are:

-     Variation to the requirement for a single driveway to serve both dwellings, this proposal provides for a new separate driveway.

-     Variation to the distance between dwellings that requires 50 metres separation, the proposal is 151 metres from the existing dwelling.

-     Variation to the building height of 8.5, the new dwelling is 10.5 metres in height.

These issues are detailed in the Section 4.15 Evaluation Report as Attachment 1 to this report.

Options:

1.   Adopt the recommendation thereby granting approval to the application, subject to conditions.

2.   Refuse the application and list reasons for refusal.

The proposed development is not expected to result in any significant broader economic implications.

Consultation:

The development was advertised and notified in accordance with the requirements of the Coffs Harbour Community Participation and Engagement Plan for a period of 14 days and one (1) submission was received in support of the application.

A formal notice of determination is valid for five years and the applicant can act on the development consent at any time within that period, subject to meeting any relevant conditions of the consent.

Conclusion:

Executive Summary

At its Ordinary Meeting of 22 April 2021, Council adopted the Community Communications and Engagement Strategy for reviewing the MyCoffs Community Strategic Plan (CSP).

Following the postponement of the NSW local government elections, minor modifications of the engagement timeframe have been made. Accordingly, the revised strategy is presented to Council for adoption.

 

Recommendation:

That Council adopt the revised Community Communications and Engagement Strategy for the MyCoffs Community Strategic Plan Review (Attachment 1).

 

Report

Description of Item:

The Local Government Act (Sections 402 and 406) requires Councils to prepare a long-term Community Strategic Plan (CSP) that covers a minimum of 10 years.

In the year of local government elections, Councils are required to undertake a comprehensive review of the CSP which is to be completed by June of the year following elections. The legislative provisions also require the preparation of a Community Communications and Engagement Strategy (Strategy) to support the development of a revised CSP.

Hence, at its Ordinary Meeting of 22 April 2021, Council considered a report on the Community Communications and Engagement Strategy, and resolved:

That Council adopt the Community Engagement Strategy for the Review of the MyCoffs Community Strategic Plan

The Strategy, has 7 key phases:

1.   Detailed planning of the Review

2.   Key service provider and government agencies engagement

3.   Promote the Review to the broader community

4.   Broader community and targeted stakeholder engagement

5.   Close the loop and publicly exhibit reviewed CSP

6.   Adopt revised CSP

7.   Evaluate effectiveness of the Review engagement techniques and methods used

Issues:

The postponement of council elections to 4 December 2021, does not alter the requirement under the Local Government Act for councils to review the CSP before 30 June 2022.

The only proposed change to the implementation timeframe is that, in order to adhere to the Local Government Elections Caretaker Period Policy, Phase 2 (engage key service providers and government agencies) will occur in October 2021 during the current term of Council, rather than in November – December 2021, as previously planned.

-     How the community would like to be kept updated and informed of the CSP, Delivery Program and Operational Plan over the next three years.

Engage with a broad cross section of the community that is representative and inclusive of the local government area’s demographics.

Target and capture voices from the community who may find it hard to engage with Council including: Aboriginal and Torres Strait Islanders, culturally and linguistically diverse, millennials, parents of young children and children under 12, people living with a disability, rural communities, young people and older people.

Options:

Council has three options available in relation to this matter:

1.    Adopt the revised Community Communications and Engagement Strategy for the MyCoffs CSP Review.

2.    Amend or reject the recommendation.  Depending on the resolution, this may mean Council will not have a Strategy to guide the review of the MyCoffs CSP and will be in contravention of the Local Government Act. 

Option 1 is recommended as the suitable course of action.

Sustainability Assessment:

•     Environment

There are no anticipated short or long-term environmental impacts from the revised timeframe of the Strategy.

•     Social

The Strategy provides a clear framework that guides the engagement process to ensure that all stakeholders within our community contribute to the review in a timely manner. The Strategy identifies hard-to-reach groups and suggests undertaking a targeted approach to capture their voices.

•     Civic Leadership

The MyCoffs CSP states that Council will undertake effective engagement and are informed - (D1.2). The Strategy is designed to make participating in the Review equitable and accessible for everyone in the broader community.

•     Economic – Broader Economic Implications

There are no broader economic implications of the revised timeframe for the phase 2 consultation.

•     Economic - Delivery Program/Operational Plan Implications

There are no resourcing implications of the revised timeframe for the phase 2 consultation.

Risk Analysis:

Adoption of the revised Strategy will not result in any significant risk to Council. A risk analysis for proposed engagement activities and events will be undertaken in accordance with Council’s Risk Management Policy.

The adopted Strategy has been developed in accordance with Council’s Community Communications and Engagement Policy, the Community Participation and Engagement Plan (CPEP) and best practice recommendations as outlined by the International Association of Public Participation (IAP2). The Strategy is based on the social justice principles of equity, access, participation and rights.

The Local Government Act 1993 (Sections 402 and 406) and the NSW Integrated Planning and Reporting Framework.

Implementation can continue and will follow the timeframes as outlined in the Strategy.
